Under AB 178 California is attempting to define affiliates as a physical sales presence in the state for out-of-state merchants such as Amazon. That would mean these merchants would be responsible for collecting sales tax from all residents in California. However history shows that if online retailers believe working with me will result in having to collect tax on all California sales they likely will sever ties with my business. Such was the case in New York where more than 200 retailers dismantled their affiliate programs leaving thousands of affiliates — small- and medium-size businesses — with a major loss of income.
